Terms of Service

These Terms of Service (“Terms”) govern your use of the Qupey app and services, operated by Qupey, Inc. (“Qupey,” “we,” “us”). By creating an account or using Qupey, you agree to these Terms.

1. Who can use Qupey

You must be at least 13 years old to use Qupey, and old enough to form a binding agreement in your location. If you use Qupey on behalf of a business, you confirm you are authorized to act for that business.

2. Your account

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information, and let us know if you believe your account has been compromised. You can delete your account at any time from within the app.

3. What Qupey is

Qupey is a platform that connects customers with local businesses through digital loyalty tools — punch cards, coupons, event passes, and passports. Offers and rewards are created and provided by the businesses, not by Qupey. Each business sets the terms of its own offers (such as expiry dates, limits, and what the reward is) and is responsible for honoring them. Qupey is not a party to, and is not responsible for, the goods, services, or rewards a business provides.

4. Acceptable use

You agree not to:

• Use Qupey for any unlawful, fraudulent, or harmful purpose.
• Attempt to earn, redeem, or claim offers dishonestly, or interfere with the redemption system.
• Harass, threaten, or abuse others, or impersonate any person or business.
• Upload content that is illegal, infringing, hateful, obscene, or otherwise objectionable.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the app or its systems.

5. Your content

You keep ownership of the content you upload (such as photos and text). By uploading it, you grant Qupey a non-exclusive license to store, display, and use that content to operate the service. You are responsible for the content you post and confirm you have the right to share it. We may remove content, and suspend or terminate accounts, that violate these Terms.

6. Reporting and moderation

We do not tolerate objectionable content or abusive behavior. You can report content or a user, or block a user, within the app, or by emailing us at the address below. We review reports and act on violations, which may include removing content or terminating accounts.

7. Business offers

Because businesses control their own offers, availability, caps, and expiry are set by them and may change. If a business declines to honor an offer, that is a matter between you and the business; however, we welcome reports so we can address bad actors on the platform.

8. Intellectual property

The Qupey name, logo, and app are owned by Qupey, Inc. and are protected by law. These Terms do not grant you any right to use our branding without our permission.

9. Disclaimers

Qupey is provided “as is” and “as available.” We do not guarantee that the app will always be uninterrupted, error-free, or that any particular offer will be available.

10. Limitation of liability

To the fullest extent permitted by law, Qupey, Inc. is not liable for indirect, incidental, or consequential damages arising from your use of the app, or for the acts or omissions of the businesses whose offers appear on Qupey.

11. Termination

You may stop using Qupey and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the service in a way that harms Qupey or others.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of Qupey after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
